FLXE AI Terms of Service

1. Introduction
 

FLXE AI is a trading name of Wynners LTD ("we", "our", or "us"), a company registered in England and Wales (Company No. 17391695), whose registered office is at 8A Tysoe Close, Redditch, B98 0TB, United Kingdom. We respect your privacy and are committed to protecting your personal data. This Privacy Policy explains how we collect, use, store and protect your information when you use the FLXE AI mobile application, www.flxeai.com, and related services.

These Terms of Service ("Terms") govern your access to and use of the FLXE AI mobile application, website, and any related services (collectively, the "Services").
 

By creating an account, accessing, or using the Services, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use FLXE AI.
 

2. Definitions
 

For the purposes of these Terms:

• App means the FLXE AI mobile application.

• Services means all features, content, tools, and functionality provided by FLXE AI.

• User, you, and your refer to any person using the Services.

• We, our, and us refer to Wynners LTD, trading as FLXE AI.
   

3. Eligibility
 

You must be at least 13 years old to use FLXE AI.
 

By using the Services, you confirm that:

• you are at least 13 years of age;

• you have the legal capacity to enter into these Terms;

• you will use the Services responsibly; and

• any information you provide is accurate and up to date.
   

4. User Accounts
 

When creating an account, you agree to:

• provide accurate and complete information;

• keep your login credentials secure;

• maintain the confidentiality of your password;

• notify us promptly if you believe your account has been accessed without your permission; and

• accept responsibility for all activity that occurs under your account.
   

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.
 

5. Acceptable Use
 

You agree not to:

• use FLXE AI for any unlawful purpose;

• interfere with or disrupt the operation of the Services;

• attempt to gain unauthorised access to our systems;

• reverse engineer, decompile, or modify any part of the Services except where permitted by law;

• upload malicious software or harmful code;

• misuse or abuse the Services in any manner; or

• infringe the intellectual property rights of FLXE AI, Wynners LTD, or any third party.
   

6. Health and Medical Disclaimer
 

FLXE AI is intended to provide general fitness and recovery guidance only.
 

The Services are not medical advice, healthcare services, diagnosis, or treatment. This applies equally to any guidance, exercises, or recommendations shared by coaches or other users through the community features described in Section 7 - such content is user-generated and is not reviewed, verified, or endorsed by us as medical or professional advice.

You should consult a qualified healthcare professional before beginning any new exercise programme, particularly if you:

• have a medical condition;

• have a pre-existing injury;

• are recovering from surgery;

• experience pain during exercise; or

• have concerns about your physical health.
   

You should stop exercising immediately if you experience pain, dizziness, or other concerning symptoms.
 

You use FLXE AI entirely at your own risk.
 

7. Community Features and User-Generated Content

FLXE AI includes community features, including the ability for users to act as "coaches" and run recovery groups.

​

Content shared within the community - including by coaches - is user-generated and reflects the views of the individual user, not FLXE AI or Wynners LTD. We do not vet, verify, or endorse coach status, qualifications, or any guidance shared within community groups.

You are responsible for your own conduct and content within community features. We reserve the right to remove content, restrict community access, or suspend accounts that breach these Terms or the Acceptable Use provisions in Section 5.

Do not treat community or coach content as a substitute for professional medical or fitness advice.

 

8. Image Analysis
 

Certain features of FLXE AI require you to upload photographs for analysis.
 

At the time of publication:

• uploaded images are analysed solely to generate exercise recommendations;

• images are not permanently stored by FLXE AI after processing;

• image analysis does not constitute medical assessment or diagnosis.
   

Future versions of FLXE AI may introduce additional analysis features. Any material changes will be reflected in updated Terms and our Privacy Policy.
 

9. Intellectual Property
 

All rights, title, and interest in the Services remain the property of Wynners LTD.
 

This includes, but is not limited to:

• software;

• source code;

• branding;

• logos;

• trademarks;

• graphics;

• exercise libraries;

• written content;

• website content;

• databases; and

• all other intellectual property associated with FLXE AI.
   

You may not copy, reproduce, distribute, modify, or commercially exploit any part of the Services without our prior written permission.
 

10. Privacy
 

Your use of FLXE AI is also governed by our Privacy Policy.
 

By using the Services, you acknowledge that you have read and understood our Privacy Policy and consent to the collection and use of information as described within it.
 

11. Availability of the Services
 

We aim to keep FLXE AI available at all times. However, we do not guarantee that the Services will be uninterrupted, error-free, secure, or always available.
 

We may suspend, restrict, or discontinue parts of the Services at any time for maintenance, updates, security reasons, or other operational purposes.
 

12. Future Paid Features
 

The FLXE AI app is free to download and most content and features are free to access.

Certain features are paid, including (but not limited to) coaching plans and a premium upgrade, offered on a monthly subscription basis through the applicable app store (e.g. the Apple App Store or Google Play).

​

Pricing, billing frequency, and available plans will be clearly displayed within the app before you purchase. Payment, billing, and subscription management (including renewals, cancellations, and refunds) are handled through the relevant app store and are subject to that app store's own terms and policies, in addition to these Terms.

​

You may cancel a paid subscription at any time through your app store account settings. Cancellation will stop future renewals but does not automatically entitle you to a refund for the current billing period, except as required by law or by the applicable app store's policies.

​

We reserve the right to introduce additional paid features, subscriptions, or services, or to change pricing, in the future. Any such changes will be clearly communicated before they take effect.

13. Account Suspension and Termination
 

We may suspend or terminate your access to FLXE AI if:

• you breach these Terms;

• you misuse the Services;

• your use poses a risk to other users or our systems; or

• we are required to do so by law.
   

You may stop using FLXE AI at any time.
 

14. Disclaimer of Warranties
 

To the fullest extent permitted by law, FLXE AI is provided on an "as is" and "as available" basis.
 

We make no warranties or representations regarding:

• the accuracy or completeness of the Services;

• uninterrupted availability;

• freedom from errors or defects; or

• fitness for any particular purpose.
   

15. Limitation of Liability
 

To the fullest extent permitted by law, Wynners LTD and its owners shall not be liable for:

• personal injury resulting from exercises performed using the Services;

• loss of data;

• loss of profits;

• business interruption;

• indirect, incidental, special, or consequential damages;

• device damage;

• technical failures; or

• any losses arising from your reliance on recommendations provided through the Services, including recommendations shared through community or coach features.

Nothing in these Terms excludes or limits liability where such limitation would be unlawful.
 

16. Changes to the Services
 

We may modify, improve, suspend, or discontinue any feature of FLXE AI at any time without prior notice.
 

17. Changes to these Terms
 

We may update these Terms from time to time.
 

Where appropriate, we will notify users of material changes.
 

Your continued use of FLXE AI after updated Terms become effective constitutes acceptance of the revised Terms.
 

18. Force Majeure
 

We shall not be liable for any failure or delay in performing our obligations where such failure results from events beyond our reasonable control, including but not limited to natural disasters, power failures, internet outages, acts of government, cyber attacks, or other unforeseen circumstances.
 

19. Governing Law
 

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
 

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
 

20. Severability
 

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
 

21. Entire Agreement
 

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FLXE AI regarding your use of the Services and supersede any previous agreements relating to the Services.
